US Judge Overturns Trump's Halt on Orsted's Offshore Wind Project (2026)

In a significant ruling, a federal judge has allowed the Danish offshore wind energy company Orsted to resume work on its nearly completed Revolution Wind project in Rhode Island. This project had been put on hold by the Trump administration, along with four other offshore ventures, just last month due to alleged national security concerns. But here's where it gets controversial: Judge Royce Lamberth's decision represents a legal blow to Trump, who has actively sought to impede the growth of offshore wind energy in federal waters over the past year.

This is not the first time Orsted has successfully challenged a government directive; this marks the second temporary order the company has secured in just four months against a stop-work order affecting the $5 billion Revolution Wind initiative. In this ongoing legal battle, Orsted's case is among several others filed by different offshore wind companies and state authorities aiming to reverse the Interior Department's suspension on December 22. The department claimed the halt was necessary due to new classified information regarding potential radar interference linked to national security.

The hearing on Monday was only the first of three scheduled for the week, with subsequent hearings addressing additional projects such as Equinor's Empire Wind off New York’s coast and Dominion's Coastal Virginia Offshore Wind facility. While there was no immediate response from the Interior Department regarding the ruling, Orsted expressed its intent to proceed with the Revolution Wind project as quickly as possible as the lawsuit unfolds. The company stated, "Revolution Wind will determine how best it may be possible to work with the US Administration to achieve an expeditious and durable resolution."

During the proceedings, government lawyers defended the pause by referencing classified data provided by the Defense Department concerning the impacts of offshore wind projects on national security. However, Judge Lamberth dismissed these claims, suggesting that halting the project would lead to irreparable damage. He posed a pointed question to Justice Department attorney Peter Torstensen: "You want to stop everything in place, costing them one-and-a-half million a day, while you decide what you want to do?"

Moreover, Lamberth expressed concern over comments made by Interior Secretary Doug Burgum, who had criticized offshore wind initiatives for reasons not related to national security. On the same day as the suspension announcement, Burgum labeled offshore wind as expensive, unreliable, dependent on foreign equipment, and detrimental to marine ecosystems.

Orsted’s attorney, Janice Schneider, argued that the government's pause violated established federal procedures and due process rights, emphasizing that the developer had not been granted access to the classified assessment concerning offshore wind’s implications. She stated, "This Court should be very skeptical of the government's true motives here."

The Revolution Wind project, which is currently around 87% complete, is anticipated to commence power generation within the year, according to Orsted. The venture operates as a 50-50 partnership between Orsted and Global Infrastructure Partners’ Skyborn Renewables. Additionally, Orsted has initiated legal action regarding its Sunrise Wind project off New York’s coast.
